1. Who can play

Emoji Roll is a general-audience game for people aged 13 and over. If you're under the age of majority where you live, a parent or guardian should review these Terms with you, and must approve any purchase.

2. Your licence to use the App

We give you a personal, non-exclusive, non-transferable, revocable licence to install the App and play it on Android devices you own or control, for your own non-commercial entertainment. This licence is subject to these Terms and to the Google Play Terms of Service. You may not:

3. Playing fair

Please don't tamper with the App or interfere with how it works. That includes modified versions of the App, tools that block or fake ads, or attempts to unlock "No Ads" without buying it. Don't use bots or scripts to generate ad impressions or clicks, and don't deliberately click ads you're not interested in. Invalid ad activity breaks Google's rules and can stop the game from being free for everyone.

4. Coins, scores and progress

Coins collected in the game, your best score and your other progress exist only to make the game fun. They're not money or property, have no cash value, can't be bought, sold, transferred or redeemed for anything, and give you no ownership rights. This progress is stored only on your phone (see the Privacy Policy). Uninstalling the App, clearing its storage or changing phones may erase it, and we can't recover it.

5. Ads

The free version of the App shows banner ads and occasional full-screen ads served by Google AdMob. Ads are created by third-party advertisers, not by us. We don't endorse them and aren't responsible for advertisers' products, services or websites. Your dealings with any advertiser are between you and that advertiser.

6. The "No Ads" purchase

7. Play safely

You steer by tilting your phone and tap the screen to jump. Play only where it's safe to do so: sitting or standing still, aware of your surroundings and holding your device securely. Never play while driving, cycling or walking. Take breaks. If you experience discomfort, dizziness or any symptoms related to flashing images, stop playing and consult a doctor if needed.

8. Ownership and credits

The App, including its game design, levels, code, sounds, music, artwork (other than as noted below) and the Emoji Roll name, is owned by us or our licensors and is protected by copyright and other laws. Except for the licence in section 2, no rights are granted to you.

The emoji artwork is from Noto Emoji by Google, used under the Apache License 2.0. Your rights to that artwork are governed by that licence. Emoji Roll is not affiliated with or endorsed by Google, the Unicode Consortium or any emoji vendor.

9. Google Play and other services

The App is distributed through Google Play and relies on Google services for ads and purchases. Your use of those services is also subject to Google's own terms and privacy policy. We're not responsible for third-party services, including apps you choose to share your score to, and they may change or stop working outside our control.

10. Changes and availability

We may update, change or remove features of the App, change these Terms, or stop offering the App, at any time. If we change these Terms, we'll post the new version on this page and update the effective date. If the changes are significant, we'll also give notice in the App's Google Play release notes. If you keep playing after changes take effect, you accept them. We don't guarantee the App will always be available, work on every device or be free of interruptions.

11. Ending your use

You can stop using the App at any time by uninstalling it. We may suspend or end your licence if you seriously or repeatedly break these Terms. Sections 4, 8 and 12 to 15 continue to apply after your licence ends.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. THIS INCLUDES IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS, OR THAT YOUR PROGRESS WILL BE PRESERVED.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMAGINE MOBILE MARKETING AND ITS OWNERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROGRESS, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, ON ANY LEGAL THEORY. THIS APPLIES EVEN IF WE'VE BEEN TOLD SUCH DAMAGES ARE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE "NO ADS" PURCHASE, OR (B) USD $50.

SOME JURISDICTIONS DON'T ALLOW THESE EXCLUSIONS OR LIMITATIONS, SO SOME MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CAN'T BE LIMITED BY LAW, INCLUDING FOR FRAUD, OR FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE.

14. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The UN Convention on Contracts for the International Sale of Goods does not apply.

Talk to us first. If you have a problem, email privacy@customblogs.net. We'll try in good faith to sort it out, and we ask you to give us 30 days before starting formal proceedings. If we can't resolve it, disputes go exclusively to the state or federal courts located in Delaware, and both of us consent to their jurisdiction. Either of us may still seek urgent injunctive relief in any competent court.

If you're a consumer in the European Union, the United Kingdom, or anywhere else whose law gives you the right to bring proceedings in your local courts or the protection of mandatory consumer law, this section doesn't take that away.
